Mental Health and Capacity Law Conference 2019

The annual Mental Health and Capacity Law conference takes place on Saturday 6 April at Brookfield Health Sciences Complex, UCC.

This conference is jointly hosted by the Centre for Criminal Justice & Human Rights, School of Law, UCC and the Irish Mental Health Lawyers Association.

Topics to be considered will include recent case-law on the Mental Health Act 2001, developments in capacity law and comparative reflections on mental health law in England & Wales. 

The conference is topical as there have been two relevant amending Acts passed in 2018:
- the Mental Health (Renewal Orders) Act 2018
- the Mental Health (Amendment) Act 2018 [not yet commenced] 

In addition, discussions are continuing on the implications of the Assisted Decision-Making (Capacity) Act 2015, due to be commenced in 2020.  The commencement of this Act will further the state’s progress towards implementation of the Convention on the Rights of Persons with Disabilities, which Ireland ratified in 2018.

Mental Health and Capacity Law Conference 2018

The Centre for Criminal Justice and Human Rights, School of Law, University College Cork and Irish Mental Health Lawyers Association held their 2018 conference on Mental Health Law and Capacity Law in UCC on Saturday 12 May 2018.

Topics discussed included Recent Developments in Mental Health Law, Dealing with Capacity Issues in Practice, and Children and the Mental Health Act 2001.

Ms Katharine Kelleher, Partner,  Comyn Kelleher Tobin, Solicitors, Cork, spoke on  ‘Section 25  Mental Health Act 2001 in practice from a legal perspective'. Ms Kelleher outlined how children with mental disorders are detained in approved centres by the District Court.  She discussed the evidence required at these court hearings and issues such as what happens when the children reach the age of 18. 

Ms Freda McKittrick, Head of Barnardos Guardian ad Litem Service:   ‘Catching or Falling? The experience of working with children in the Mental Health and Child Care Systems’. 
In this paper, Ms McKittrick outlined what works for children with mental health issues: continuity of service, structural integration of services, and where services are well established and prepared to manage risk.

Dr Anne Jeffers, Consultant Psychiatrist, spoke about the College of Psychiatrists of Ireland REFOCUS Group.  REFOCUS is the Recovery Experience Forum of Carers and Users of Services. REFOCUS is made up of 10 people with experience of mental illness, and ten people who had family members who used the services. The aim of the forum is to actively engage with the College of Psychiatrists, in order to improve the education of psychiatrists, and thereby improve mental health services. 

Dr Lisa Butterly, Historian:   ‘A Jury of My Peers’. 
Dr Butterly said she feels resentful of how poorly Ireland treats people with schizophrenia.  She highlighted the stigma attached to schizophrenia and noted that stigma bypasses self-determination, destroys self-esteem and destroys self-identity. 

Ms Brid Breathnach, Deputy Official Solicitor and Senior Civil Litigation Lawyer, Office of the Official Solicitor, London: ‘Serious medical treatment applications in the Court of Protection in England and Wales - a practitioner's perspective’:
Ms Breathnach said that the use of independent experts was an important safeguard in medical treatment cases. She spoke about recent cases in the Court of Protection, including cases concerning termination of pregnancy and persons in a vegetative state.

Mr Michael Lynn, Senior Counsel:  ‘Recent Developments in Mental Health Law’: 
Mr Lynn discussed important cases such as  A.B. v. Clinical Director of St. Loman’s Hospital,
Court of Appeal, 2018, where the court declared that s.15(3) of the Mental Health Act 2001 is unconstitutional.  The declaration stands suspended until November 2018.

Ms Áine Hynes, Partner, St. John Solicitors, Dublin:  ‘Dealing with Capacity Issues in Practice - Recent Developments’: 
Ms Hynes discussed how the High Court's wardship jurisdiction has become more flexible in recent years.  She also noted that a solicitor has a special duty of care in respect of vulnerable clients, and that a family member cannot give instructions to a solicitor for another family member lacking in mental capacity.

    Call for Papers Centre for Criminal Justice and Human Rights Postgraduate Conference 2011

    The Centre for Criminal Justice and Human Rights at University College Cork is pleased to announce its fifth Annual Postgraduate Conference which will take place on Thursday, 28th April, 2011. The conference is aimed at those who are undertaking postgraduate research in the areas of criminal law, criminal justice and human rights. The Organising Committee is particularly eager to incorporate multi-disciplinary perspectives. Abstracts are welcome from scholars from disciplines outside of law (such as politics, social studies, sociology and philosophy, for example) who are working on related topics.

    The theme for this year's event is “Human Rights Protection and Criminal Justice in the Age of Crisis”. The aim is to reflect upon the impact of crises on fundamental rights protection and the criminal law. We hope that this theme will encourage debate on the challenging and complex questions which arise in turbulent times. We are especially interested in papers that relate to human rights, criminal justice, criminal law or the intersection of these fields. However, we also welcome papers dealing with issues outside these areas that fall within the broader theme of the conference. Papers will be streamed thematically. Anticipated sessions include "Contemporary Discourse in Criminal Law", "Civil Liberties, Technology and State Security Claims" and "International Law, Human Rights and Development Policy". Session titles will be finalised based on submissions, and the Committee also invites proposals for additional streams.

    This international one-day event has attracted promising research scholars from Ireland, the UK and Europe in the areas of law, politics, philosophy and the related social sciences. This year's conference aims to build on this success.

    Organised by the Irish Council for Civil Liberties (ICCL) and the Centre for Criminal Justice and Human Rights, University College Cork (UCC)


    The Irish Council for Civil Liberties (ICCL) and the Centre for Criminal Justice and Human Rights at University College Cork are organising an evening seminar on judicial diversity. The purpose of the event is to open up a discussion about the possibilities of achieving greater judicial diversity in Ireland.


    This seminar is aimed at members of the judiciary, practitioners, parliamentarians, policy makers, academics, non-governmental organisations (NGOs), students and anyone interested in judicial diversity.


    The event is scheduled to take place from 6-8pm on Thursday, 18 September 2008 in the Atrium, the Law Library, Distillery Building, Church Street, Dublin 7.

    The Speakers


    Baroness Usha Prashar CBE is Chairman of the United Kingdom's Judicial Appointments Commission, a Governor of the Ditchley Foundation, a non-executive Director of ITV, Trustee of Cumberland Lodge, non-executive Director of the Cabinet Office, a Governor of Ashridge College, President of the Community Foundation Network, President of UK Council for International Student Affairs and a Patron, The Runnymede Trust.


    Her previous posts include First Civil Service Commissioner, Chairman of the Royal Commonwealth Society, Chancellor of De Montfort University, Executive Chairman of the Parole Board for England and Wales, Director of the National Council for Voluntary Organisations, Chairman of the National Literacy Trust and Director of the Runnymede Trust. She sits in the House of Lords as a cross-bencher.


    Professor Kate Malleson joined the Queens Mary School of Law in 2005. Before coming to QM she taught at the London School of Economics. Her main research interests are the judiciary, the legal system and the constitution. She is currently working with colleagues at UCL on a three-year AHRC funded project on the selection process of the international judiciary. The project will identify and analyse the criteria and procedures by which judges are nominated and elected to the international courts.


    She has a particular interest in the current constitutional reforms in the UK and acted as a specialist adviser to the House of Commons Constitutional Affairs Select Committee assisting it in its review of the provisions of the Constitutional Reform Bill. She also gave oral evidence to the House of Lords select committee on the Bill and last year was asked by the House of Lords Constitution Committee to provide a written report on the effect of the Constitutional Reform Act 2005 on the relationship between the judiciary, Parliament and the executive. In 2006-7 she chaired a JUSTICE committee on 'A Bill of Rights for Britain' which reviewed the problematic legal and political issues involved in assessing whether or not there is a case for creating a specific British bill of rights.


    Dermot Feenan is a Lecturer in the Law School, University of Ulster. He was Co-chair of the International Research Collaborative on Gender and Judging, 2006-2007, set up under the auspices of the Law and Society Association, which hosted sessions at the Society's Annual Meeting in Baltimore, 2006, and its joint meeting in Berlin 2007 with several other socio-legal associations worldwide. He has held visiting positions at a number of universities, including: Cornell, Keele, Melbourne, Monash, Oxford, and Trinity College, Dublin.


    He is currently completing a paper for publication on the topic of women's experiences as judges, as revealed in his research on Northern Ireland and as reported in the literature, in order to enhance knowledge and understanding of law, legal authority and diversity. He is also designing a research project on women judges' experiences in three common-law countries, which will lead to further publication.
